These terms These are the terms and conditions under which we supply our Products to you (particularly, through our website).
1.2
What these terms tell you Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide Products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms or such terms require any changes, please contact us.

Agreeing to these terms By using our Platform, you agree to these terms. If you are using our Platform as a representative of an entity, you are agreeing to these terms on behalf of that entity.

How we may contact you If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address provided by you.
3.YOUR ORDER
3.1
How do we accept your order Your order will take place immediately after our email reply to you to confirm our acceptance, at which point a contract will come into existence between you and us.
3.2
What if we cannot accept your order If we are not able to accept your order, we will inform you and will not charge you for the Product ordered. This might be caused by: (1) the Product ordered is out of stock; (2) there are unexpected limits on our resources which we could not reasonably plan for; (3) we have identified an error in the price or description of the Product; (4) we are unable to meet a delivery deadline you have specified or (5) any other reason that makes the supply of Products unfeasible.
3.3
Your order number We will assign an order number to each order. Please tell us the order number whenever you contact us about your order.
4.OUR PRODUCTS
4.1
Products may vary slight from photos The images of the Products on our website are for illustrative purposes only. Although we have made every effort to display the appearance of our Products accurately, we cannot guarantee that the actual appearance (particularly, the colours) of the Products will appear the same in everyone’s display of his/her device. Products that you purchase may vary slightly from those images.
4.2
Products may vary slightly from measurements Although we have made every effort to be as accurate as possible, all sizes, weights, capacities, dimensions, measurements and packaging indicated on our website have a tolerance.
5.DELIVERY
5.1
Delivery We will deliver the Products to the postal address as specified in your order as soon as possible. The costs of delivery will be as displayed to you on our Platform. Please provide us with a valid address to ensure effective delivery.
5.2
Delays If Products are delayed by an event out of our control, we will contact you and take steps to minimise the delay.
5.3
What happens after a failed delivery In case of any failed delivery caused by any reason, we will inform you but we will not arrange further delivery immediately. You need to contact us to re-arrange delivery and we reserve the right to charge you the extra storage costs and delivery costs particularly if such failure is caused by your reason. We may terminate our contract with you under the following circumstances: (1) there is no response from you 3 months after our notice of failed delivery to you, (2) further delivery is not feasible due to objective reason, and/or (3) any other reason which makes the execution of the Contract frustrate.
5.4
When you become responsible for the product A Product will be your responsibility immediately after the delivery to the postal address provided by us (unless the delivery is failed).
5.5
When you own the product You own a Product once we have received payment in full and the delivery of the Product.
5.6
When we ask for more information We may need certain information from you to ensure the supply of the Products to you. We will contact you to ask for this information. If you do not give us this information within a reasonable time of us asking for it, we may either charge you additional fees or, in the worse case (i.e. delivery becomes unfeasible due to the lack of the requested information), terminate the contract.
5.7
What happens if we stop supplying a product? We may have to suspend the supply of a Product and we will not accept further order for any such Product. We will refund to you if we accidentally accepted such order and received the payment.
6.PRICE AND PAYMENT
6.1
Paying for your product The price of the Product will be the price indicated on the order pages when you placed your order. You must pay for the products before we dispatch them. We will send an invoice for the price of the Products upon completion.
6.2
Sales tax Our prices include sales tax. If the rate of tax changes between the date of your supply and the date we supply the product, we will adjust the price and you may need to make further payment or receive refund (as the case may be).
6.3
What happens if you don’t pay us If you do not pay us for the Products when you are supposed to or after reminders that payment is due, we may suspend supply until you have paid us the outstanding amounts or terminate any order or Contract with you.
7.RETURNS AND EXCHANGES
7.1
Exchanges If you wish to make a change to the Product you ordered, please contact us in due course. We have full discretion on whether or not to accept any such changes requested by us after acceptance of the order. We will let you know about any changes to the price, timing or anything else as a result of your change and ask you to confirm. If we cannot make the change or the change is unacceptable to you, you may want to end the contract.
7.2
Returns We may or may not charge your further fees when you return the Product(s) delivered to you. We may not accept return if the Product(s) has been delivered in accordance with the order and/or particularly if the Product(s) comply with our Contract.
7.2.1 When we will pay for returns We will pay for returns only if (1) the Products are faulty or misdescribed, (2) there is an upcoming change to the Product or these terms, (3) there is an error in pricing or description, , (4) and you have a legal right as a result of something we have done wrong.
7.2.2 When you will pay for returns In all other circumstances which are not specified in the Clause 7.2.1 above, you must pay for returns of Products.
7.3
What happens if we get the price wrong It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. If the product's correct price at your order date is higher than the price stated, we will offer you the option to either confirm your order at the correct price or cancel your order. If the correct price at your order date is lower than the price stated, we will refund you the difference.
8.LIABILITY AND PROBLEMS
8.1
Liability We are responsible to you for foreseeable loss and damage caused by us. Loss or damage is foreseeable either if it is obvious that it will happen or, at the time the contract was made, both we and you knew it might happen, for example, we had discussion with you during the sales process.
8.2

9.ENDING THE CONTRACT
9.1
Yours rights to end the contract Your rights when you end the contract will depend on what you have bought, whether there is anything wrong with it, how we are performing, when you decide to end the contract and any other reason.
9.2
Terminating the contract after 14 days You have right to request for terminating the Contract within fourteen (14) days after acceptance of your order and receive a refund. To terminate the contract with us, please fill in our online return form or post a printed return form to us, or email our customer services at info@octo-time.com.
9.3
Refunds after you terminate the Contract If you terminate the contract with us, we will refund you the price you paid for the Products including delivery costs, but we may make deductions from the price.
9.4
Our rights to terminate the Contract We may terminate the Contract for a Product at any time if you do not make any payment to us when it is due and you still do not make payment after reminding you that payment is due. We may end the contract for a Product if you do not provide us with information necessary for us to provide Products.
9.5
Refunds after we end the contract If we terminate the contract, we will refund any money paid in advance for Products we have not provided but we may deduct reasonable compensation for net costs we incur as a result of breaking the contract.
10.OTHER TERMS
10.1
Changes in Terms and Conditions We may change these terms and conditions from time to time.
10.2
Changes in Products We may make minor changes to the Product from time to time in order to reflect changes in relevant laws and regulatory requirements. These changes may or may not your use of the product but we will use reasonable efforts to reduce your inconvenience.
10.3
Your personal data When you register and otherwise use our Platform, you provide us with personal data which is collected and used in accordance with the terms of our privacy policy which is accessible at www.octo-time.com.
